Terms of Service

Welcome to aiMakeVideo. By accessing or using our AI video and image generation service at https://aimakevideo.com (the “Service”), you agree to these Terms of Service (“Terms”), our Privacy Policy, and our Refund & Billing Policy. If you do not agree, do not use the Service.

These Terms are between you and the operators of the aiMakeVideo service. In these pages, “we,” “us,” and “aiMakeVideo” mean that service.

1. Introduction

aiMakeVideo is a multi-model AI video and image studio at https://aimakevideo.com. You can generate clips and stills, buy optional subscriptions, and purchase one-time credit packs. Payments are processed by third-party providers such as Stripe when enabled.

2. Eligibility

You must be at least 18 years old and able to form a binding contract. If you use the Service for an organization, you represent that you have authority to bind that organization.

The Service is not directed to children. We do not knowingly collect personal information from anyone under 18.

3. Accounts

You may sign up with email and password or with a supported third-party login such as Google. You are responsible for:

• providing accurate account information;
• keeping your password and connected accounts secure;
• all activity that occurs under your account.

Notify us immediately at support@aimakevideo.com if you suspect unauthorized use. We may refuse, suspend, or close accounts that appear abusive, fraudulent, or in violation of these Terms.

4. The Service

The Service lets you submit prompts, reference images, and other inputs to third-party AI models and receive generated video or images. Features, models, quality, speed, and availability can change. We may add, modify, or discontinue models or tools with or without notice.

We do not guarantee that any generation will meet a particular creative, commercial, legal, or technical standard. AI output is non-deterministic: the same prompt can produce different results, and results may be inaccurate, incomplete, or unexpected.

Credits are estimated before a job runs. Higher resolution, longer duration, or premium models usually cost more. If a provider call or the generation task itself fails or is canceled before a successful result, charged credits for that job are typically returned to your balance automatically. A successful generation consumes credits even if you dislike the output.

5. Subscriptions and credit packs

Subscriptions

We may offer paid plans (currently marketed as Basic, Standard, Pro, and Max) billed monthly or yearly in advance. Unless you cancel, a subscription automatically renews at the then-current price for the same interval, and your payment method is charged at the start of each new period.

You can cancel from Settings → Billing. Cancellation stops the next renewal. You keep access through the end of the paid period. Unused subscription credits generally expire at the end of that billing period and do not roll over unless we expressly say otherwise in the product.

Yearly plans are billed as one charge for the year. Canceling a yearly plan stops the following year’s renewal; it does not automatically create a prorated cash refund for unused months.

Credit packs

Credit packs are one-time purchases. They do not auto-renew. Pack credits are granted after successful payment and remain valid for 180 days from the grant date (CREDIT_PACK_VALID_DAYS = 6 × 30 days). Unused pack credits expire after that window and are not converted to cash.

If you have an active subscription at the time you buy a pack, that pack grants 20% extra credits at the same pack price. The bonus is applied to that purchase only. Canceling later does not remove bonus credits already granted. Buying a pack without an active subscription grants the base pack amount only.

Pack credits sit alongside subscription credits. The product consumes credits that expire sooner first, so monthly plan credits are typically used before longer-lived pack credits.

Credits are not money

Credits are a limited license to use the Service. They have no cash value, are not transferable except as required by law, and are not a stored-value or banking product. See the Refund & Billing Policy for renewals, cancellations, refunds, and chargebacks.

6. Acceptable use

You agree not to use the Service to:

• violate any applicable law or regulation;
• create or request child sexual abuse material or sexual content involving anyone 17 or under, or any exploitative content involving minors;
• generate non-consensual intimate imagery, or realistic deepfakes of a real person used to defame, harass, commit fraud, or impersonate them without a lawful basis;
• infringe copyrights, trademarks, publicity rights, or other rights;
• upload content you do not have the right to use as a prompt or reference;
• attempt to probe, scan, or break the Service, other users’ accounts, or our providers;
• scrape, harvest, or bulk-extract the Service except through an official API we expressly provide;
• send malware, spam, or other harmful material;
• evade usage limits, credit charges, filters, or payment systems;
• resell raw access to the Service in a way that disguises you as aiMakeVideo.

We may remove content, withhold or revoke credits, suspend generation, or close accounts when we reasonably believe these rules were broken. We may also cooperate with payment providers and law enforcement.

7. Your inputs

You retain whatever rights you already have in prompts, uploads, and other materials you submit (“Inputs”). You grant us a worldwide, non-exclusive license to host, transmit, and process Inputs as needed to operate the Service — including sending them to AI, storage, and payment providers.

You represent that you have all rights needed for those Inputs and that they do not violate these Terms or third-party rights.

8. AI outputs and licenses

Subject to these Terms, your payment status, and any third-party model terms, we assign to you the rights we can assign in the outputs generated for your account (“Outputs”).

Important limits:

• Basic plan users receive a personal, non-commercial license to use Outputs unless we grant broader rights in writing.
• Standard, Pro, and Max plans include a commercial usage license for Outputs you generate while that plan is active, as described on the pricing page. That license does not include rights to other people’s Inputs, trademarks, or likenesses you did not clear.
• Model providers (for example video or image model vendors) may impose additional terms. Those terms can restrict commercial use, publicity, or certain subject matter even when your plan says “commercial.”
• We do not warrant that Outputs are unique, that they do not resemble other users’ results, or that they are free of third-party claims.
• You are responsible for reviewing Outputs before you publish, sell, or rely on them.

We may use aggregated, de-identified usage data to operate and improve the Service. We do not claim ownership of your Inputs solely because you used the studio.

9. Our intellectual property

The Service — including the site, software, design, trademarks, and documentation — is owned by us or our licensors. These Terms do not transfer those rights. You may not copy, reverse engineer, or reuse our branding except as needed to use the Service or as allowed by law.

10. Third-party services

The Service depends on third parties, including:

• payment processors (such as Stripe and any other method we enable);
• authentication providers (such as Google);
• email delivery (such as Resend);
• hosting, database, and object storage (such as Cloudflare Workers, D1, and R2);
• AI model and infrastructure providers that run generation jobs.

Their outages, safety filters, or policy changes can affect your results. Their terms apply to their processing of your data and, in some cases, to Outputs.

11. Availability and support

We aim to keep the Service available but do not promise uninterrupted or error-free operation. Maintenance, model changes, abuse prevention, and provider limits can delay or block jobs.

12. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS ARE ACCURATE, LAWFUL FOR YOUR USE CASE, OR FIT FOR PRODUCTION WITHOUT YOUR REVIEW.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM, OR USD $50 IF YOU HAVE NOT PAID US.

Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the maximum extent permitted.

14. Indemnity

You will defend and indemnify us against claims, damages, and expenses arising from your Inputs, your Outputs, your use of the Service, or your violation of these Terms or third-party rights, except to the extent caused by our willful misconduct.

15. Suspension and termination

We may suspend or terminate access if you breach these Terms, if required by a provider or by law, or if we discontinue the Service. You may close your account by contacting support@aimakevideo.com or using available account settings.

On termination, your right to use the Service ends. Unused credits are forfeited except where the Refund & Billing Policy or applicable law requires otherwise. We may retain records as described in the Privacy Policy.

16. Changes

We may update these Terms by posting a new version and updating the date above. Material changes may also be announced in the product or by email. Continued use after the effective date means you accept the updated Terms. If you do not agree, stop using the Service and cancel any subscription.
